Proposed changes to child support law draws support, criticism

The seemingly never-ending list of things about which to be concerned when in the midst of a divorce can be overwhelming at times. Trying to balance what is fair along with what is palatable is a challenge common to many Houston couples. This includes child custody determinations and any related child custody issues such as child support or visitation plans for parenting time.

The laws surrounding child custody and child support vary from state to state but it can be interesting to note activity in other parts of the country. In Wisconsin, a new bill that has been proposed is drawing both support and criticism. The measure could dramatically change child support and parenting time decisions if passed. It calls for judges to no longer use assets or income as a factor in calculating support payments for those people earning more than $150,000 per year. Additionally, a greater push for maximum parenting time given to both the mother and father is called for.

Supporters of the bill indicate it is would allow courts to act in the best interests of the child by encouraging a stronger relationship with children by both parents. This is especially noted for fathers who tend to be the most common parents required to pay support. Advocates of anti-domestic violence activities are among the bill’s strongest critics. It is not clear whether or not the bill will pass nor is it clear it could affect laws in other states.

Issues such as child support determinations and child visitation plans are rarely simple. Anyone dealing with these issues may want to talk to a family law attorney to understand how best to navigate these situations.
