The first major celebrity headline of 2013 is here. Kanye West and Kim Kardashian are pregnant. The (unofficial) announcement came during West’s concert Sunday evening in Atlantic City when he said “stop the music and make some noise to my baby mama!” referring to Kardashian, who was in attendance.
The child will be the first for the 35-year-old West, as well as 32-year-old Kardashian. The two started dating in April 2011 in the midst of the collapse of Kardashian’s marriage to Brooklyn Nets forward Kris Humphries. Their much ballyhooed romance ended 72 days after they were wed. To make matters that much more interesting, Humphries and Kardashian are still legally married. Apparently the two are disputing whether the marriage should be annulled.
Rumors swirled around the potential pregnancy after Kardashian was seen leaving an OB-GYN’s office last week. She was reportedly seeking treatment for acute morning sickness, but she was not hospitalized (as Kate Middleton was a month earlier).
In the meantime, the story offers an interesting view of the difference between how children are considered if they are born of a marriage as opposed to single parents. When a child is born from a marriage, both parents have joint legal and physical custody of the child. Also, if a woman becomes pregnant during the course of a marriage, the husband is presumed (as a matter of law) to be the biological father until proven otherwise.
We can say with reasonable certainty (barring any earth-shattering news) that Kris Humphries is not the child’s biological father, even though he would satisfy the presumption by virtue of the unresolved marriage.
