After divorcing R&B singer Eric Benet in 2003, Halle Berry is probably best known for her confessional with Oprah Winfrey when she famously said, "I will never get married again!" She held true to her stance for nearly 10 years and through a relationship that produced a child (Nahla, with Canadian model Gabriel Aubry).
However, Berry decided to give marriage one more try. She and French actor Oliver Martinez announced that they were engaged in March 2012, and the two tied the knot last weekend in France. The ceremony was reportedly an intimate affair, with 60 guests in attendance. The marriage would be the third for Berry who also married former baseball player David Justice 20 years ago.
Questions abound as to whether the marriage is a ruse of sorts to justify a move to France for Berry and her daughter. She previously sought a move when she a Martinez were dating, citing France's tougher paparrazzi laws as a reason to protect her little girl. A Southern California court disagreed, and denied her request.
It was also rumored that the Thanksgiving melee between Martinez and Aubry was calculated to lead to deportation proceedings against Aubry, which ostensibly would have cleared the way for Berry to move to France. For now, it appears that the couple will continue to reside in Southern California.
Under Texas law, relocation is based on a number of factors, including the relationship between the child and the parent to be left behind, the reasons behind the move (and the distance) and the ability for the child to maintain a relationship with both parents, among others.
If you have questions about this concept, an experienced family law attorney can help.
