What should I think about when I divorce my ex?

Having an idea that your marriage is ending is something that is often very difficult to deal with. Before you make the decision to file for divorce or before you answer a petition for divorce, you should understand exactly what a divorce can do and what it can’t do.

Each aspect of a divorce has specific considerations. Thinking about each one individually can help you as you make critical decisions.

What is property division?

The property that you and your ex have will need to be split. The property division process is where you will decide on this or ask the court to decide. There isn’t any guarantee that everything will be split evenly down the middle. Ultimately, the goal here is to have the best property division settlement to start off your new life. You should think carefully about each asset and debt so that you aren’t being shorted anywhere.

What happens to our children?

You will need to work out a child custody agreement when you end your marriage. If you and your ex can’t do this, the court will do it for you. Where the child lives, who makes decisions for the child and what visitation schedules will be are all points that are covered in the child custody paperwork. The decisions here must be in the best interests of the child.

What types of support might occur?

Divorce is usually associated with child support if there are children involved. There might also be an order for spousal support. The exact terms vary based on the circumstances of your divorce. Make sure that you understand exactly what the agreements or orders in your case say so that you can ensure you comply with them.
